SENTENCING REFORM
Well back to more news from Inmate.com. Before Thanksgiving last year, rumors were flying that white collar sentencing reform had passed and that all white collar felons were receiving time off their sentences. Of course, the rumor was false. As usual, it originated in the law library where jailhouse lawyers ply their trade. The handful of white collar guys in jesup took it with a grain of salt but were obviously hopeful that something was on the horizon.
Several months later, the U.S. Sentencing Commission did propose amendments to the White Collar Sentencing guidelines that would offer sentencing relief to various white collar offenders. The proposed changes include; (1) Modifying the loss tables in a fashion that benefits certain prisoners; (2) Revisiting the "sophisticated Means " enhancement that is given to many white collar offenders; and (3) reducing sentencing enhancements based upon the number of victims.
Nothing will be finalized by the sentencing commission until June. After that, Congress has the ability to reject any proposed changes if it so desires. Even if it is approved, the next question is whether or not it will have retroactive effect.
I would receive some benefit under the proposed changes if they are enacted. To say that does not give me some hope would be a lie. On the other hand, I think I will sit back and try to forget about all of this until it becomes a reality as opposed to a possibility.
